1. Acceptance of Terms

Welcome to TrustSense ("Platform").

These Terms of Service ("Terms") govern your access to and use of the Platform, website, APIs, applications, and related services operated by TrustSense Private Limited, a company incorporated under the Companies Act, India, having its registered office in Pune, Maharashtra ("Technolize", "Company", "we", "our", or "us").

By creating an account, subscribing to a plan, accessing, or using the Platform, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy.

If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Eligibility

To use the Platform you must:

  • Be at least 18 years of age.
  • Have legal authority to represent your organization.
  • Provide accurate and complete registration information.
  • Maintain the security of your account credentials.

You are solely responsible for all activities occurring under your account.

3. Description of Service

The Platform enables organizations to:

  • Issue digitally verifiable documents
  • Generate QR codes
  • Generate unique verification IDs
  • Create secure verification pages
  • Verify document authenticity
  • Manage issued documents
  • Manage users and permissions
  • Access APIs (Enterprise Plans)
  • Integrate with third-party business systems

We may improve, modify, add or discontinue features at any time.

4. Customer Responsibilities

You agree that:

  • All uploaded documents belong to you or you have legal authorization to upload them.
  • All uploaded information is accurate and lawful.
  • You will not upload forged, misleading, illegal, defamatory, infringing, or malicious content.
  • You are solely responsible for the content you upload.

TrustSense does not review or validate the factual accuracy of uploaded documents.

5. Verification Disclaimer

The Platform verifies whether a document matches the digital record stored by the issuing organization within our system.

The Platform does not independently verify:

  • Employment history
  • Identity
  • Educational qualifications
  • Government records
  • Legal validity
  • Financial information
  • Authenticity outside our Platform

Verification only confirms that the document corresponds to the information recorded by the issuing organization on our Platform.

6. Account Security

You are responsible for:

  • Protecting your login credentials
  • Restricting unauthorized access
  • Maintaining password confidentiality
  • Reporting suspected security incidents immediately

TrustSense shall not be liable for losses arising from compromised credentials caused by user negligence.

7. Intellectual Property

All rights relating to the Platform remain the exclusive property of TrustSense Private Limited, including but not limited to:

  • Software
  • Source Code
  • APIs
  • Database Structure
  • User Interface
  • Branding
  • Logos
  • Trademarks
  • Designs
  • Documentation
  • Technology

Nothing in these Terms transfers ownership of any intellectual property to you.

8. Customer Content

You retain ownership of:

  • Uploaded documents
  • Company logos
  • Company information
  • Verification records
  • Business data

By uploading content, you grant TrustSense a limited license solely for the purpose of operating, securing, processing, storing and delivering the Platform's services.

We never claim ownership of your documents.

9. Subscription & Billing

Paid subscriptions are billed according to the selected plan.

Unless otherwise stated:

  • Subscription fees are payable in advance.
  • GST and applicable taxes are additional.
  • Fees are non-refundable except where required by law.
  • Failure to pay may result in account suspension or termination.
  • Pricing may change for future billing cycles with prior notice.

10. Fair Usage Policy

Customers shall not abuse the Platform by:

  • Excessive automated requests
  • Scraping
  • Denial-of-service attacks
  • Excessive storage abuse
  • Excessive API requests beyond purchased limits
  • Attempting to bypass subscription restrictions

TrustSense reserves the right to temporarily restrict abusive accounts to maintain platform stability.

11. Prohibited Activities

You may not:

  • Reverse engineer the Platform
  • Copy or clone the software
  • Modify or redistribute the Platform
  • Circumvent security controls
  • Upload malware
  • Attempt unauthorized access
  • Resell the Platform without written permission
  • Interfere with other users
  • Violate applicable laws

Violation may result in immediate suspension without prior notice.

12. Beta Features

From time to time, we may release beta or preview features.

Beta features:

  • Are provided "as is"
  • May change without notice
  • May be discontinued at any time
  • May contain bugs or limitations

TrustSense makes no guarantees regarding beta functionality.

13. Availability

We strive to maintain high availability.

However, we do not guarantee uninterrupted access.

Downtime may occur due to:

  • Scheduled maintenance
  • Cloud infrastructure failures
  • Internet outages
  • Security incidents
  • Third-party provider failures
  • Force majeure events

14. Third-Party Services

The Platform may integrate with third-party providers including:

  • Cloud hosting providers
  • Payment gateways
  • Email providers
  • Authentication providers
  • HRMS platforms
  • ERP platforms

TrustSense is not responsible for the availability, policies, or services of third-party providers.

15. Data Backup

Although reasonable backups are maintained, customers are responsible for maintaining copies of important documents.

TrustSense shall not be responsible for accidental deletion caused by:

  • User actions
  • Third-party failures
  • Force majeure events

16. No Warranty

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis.

TrustSense expressly disclaims all warranties including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Continuous availability
  • Error-free operation
  • Non-interruption
  • Compatibility with every system

17. Limitation of Liability

To the maximum extent permitted under applicable law:

TrustSense Private Limited shall not be liable for:

  • Loss of business
  • Loss of profits
  • Loss of contracts
  • Loss of goodwill
  • Data loss
  • Indirect damages
  • Consequential damages
  • Special damages
  • Third-party claims
  • Business interruption

Our total liability shall never exceed the subscription fees paid by the customer during the preceding twelve (12) months.

18. Indemnification

You agree to defend, indemnify and hold harmless TrustSense Private Limited, its directors, officers, employees and affiliates against all claims, damages, liabilities, losses, legal costs and expenses arising from:

  • Your uploaded documents
  • Your misuse of the Platform
  • Violation of these Terms
  • Violation of applicable laws
  • Infringement of third-party rights

19. Suspension & Termination

We may suspend or terminate your account if:

  • These Terms are violated
  • Fraudulent activity is detected
  • Illegal content is uploaded
  • Subscription fees remain unpaid
  • Platform security is threatened

Termination may occur immediately where necessary to protect the Platform or comply with legal obligations.

20. Privacy

Your use of the Platform is also governed by our Privacy Policy.

Please review our Privacy Policy to understand how your information is collected, used and protected.

21. Changes to the Platform

TrustSense reserves the right to:

  • Modify features
  • Improve functionality
  • Remove obsolete features
  • Introduce new services
  • Update pricing
  • Modify subscription plans

Material updates will be communicated through the Platform or our website.

22. Changes to These Terms

We may update these Terms from time to time.

Continued use of the Platform after updates constitutes acceptance of the revised Terms.

23. Force Majeure

TrustSense shall not be liable for delays or failures resulting from events beyond our reasonable control, including:

  • Natural disasters
  • Floods
  • Earthquakes
  • War
  • Government restrictions
  • Internet failures
  • Cyber attacks
  • Power outages
  • Pandemics
  • Cloud infrastructure failures

24. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

25. Entire Agreement

These Terms, together with our Privacy Policy and any applicable subscription agreement, constitute the complete agreement between you and TrustSense Private Limited regarding the Platform.

26. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of India.

27. Jurisdiction

Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Pune, Maharashtra, India.
